Publisher Description:
On January 12, 2018, Justice Ranjan Gogoi and three other judges came out of the Supreme Court of India, convened a press meet and alleged that democracy was not safe in the hand of the then Chief Justice of India, Dipak Misra, They disclosed that 'many things that were less than desirable were happening in the Supreme Court of India and unless that institution is saved, democracy would not survive in India". Further, they said the Chief Justice of India was not functioning independently but was remote controlled.Everyone thought that Justice Ranjan Gogoi would use his talents to serve the country with his judgement the moment he becomes the Chief Justice of India.. Many said that he would give life to the nation. In the Union of India Vs democratic reforms, in 2002, a bench of the Supreme Court of India said that 'one sided information, disinformation, mis-information and non-information all equally create an uninformed citizenry which make democracy in India a farce'.The source of the authority of the Chief Justice of India is the Constitution of India. Hence, the Chief Justice of India is the most powerful person in India. He must ensure rule of law, freedom of expression and democracy. He must uphold the constitutional rights of the people. Thus, he must enforce the constitution of India. His accountability, therefore, must be the greatest. Similarly, the greater the responsibility, the greater the risk associated with it.When the system violates Article 19, the Chief Justice of India must stand erect and point out that the restrictive clauses would not undo freedom of expression.Yet, the Supreme Court of India did not enforce freedom of expression for the last 17 years. Thus, it did violence against Articles 19 without the slightest compunction. If the Central Bureau of Investigation (CBI) promotes corruption, the court would not interfere. If it prevents corruption, it would interfere. It conveys the impression, that the Supreme Court of India exists only to pervert justice. This condition prompted Union Finance Minister Mr. Arun Jaitely to say that 'the violation of the Constitution of India is a question of the credibility of the court'. As soon as assuming office, Chief Justice of India Ranjan Gogoi said, "It is in our best interest to heed the advice of the Constitution of India. If we do not, our hubris will result in sharp descent into chaos" When he said this, the court had frozen 647 letters from the present man alone" His words gave the impression that he was facing resistance from the media.During the Rafale hearing, the bench headed by him directed the Government to inform the decision-making process that led to the Rafale agreement.During the farewell function of Justice Kurian Joseph, Chief Justice of India Ranjan Gogoi said that the judges were fast losing the honor and majesty of office. On 26 November 2018, quoting John Sturt Mill, he said "Don't leave your liberties at the feet of even a great man".His deeds and words prompted the Attorney General of India, K, K, Venugopal that the Chief Justice of India was not above the law.The present man sent 55 letters to the Supreme Court of India for the freedom of Indians since Chief Justice of India Ranjan Gogoi assumed office on 3 rd October 2018. But, he omits to state this material fact to the illiterate people of India. These letters are necessary to the voters to take a balanced decision at the time of voting. However, they do not know such omission on the part of the Chief Justice of India. He knew that his such untruth or omission to state the material facts would mislead the people to vote in favor of two persons accused of violating Article 19 of the Constitution of India. He knew that such omission on his part would make him liable to all Indians
