| Publisher Description: English summary: Cicero once wrote that we all strive after immortality and hence take great care in drawing up our wills. According to Pliny the Younger, a testament reveals the character of the testator. Both of these statements inspired Christoph Paulus to undertake a historical study of the mentality behind the wish to achieve immortality - and to be remembered by posterity - in ancient Rome. This was truly a research topic begging to be pursued, for it was a social must among the Roman upper class to write a testament and make it publicly available during the testator's lifetime. This interaction between self-presentation and the attempt to influence posterity's view of the deceased makes these texts a highly interesting and revealing source of information. The book is based on Paulus' Habilitation thesis in law at the Ludwig-Maximilians-Universitat Munchen from 1990, in which he focused on legal sources and the legal evaluation of clauses in testaments. It makes extensive bodies of primary source material accessible for research on the history of mentalities, material which until now has remained largely the domain of Roman legal history. Ein naheliegendes Forschungsvorhaben, gehorte es in der romischen Oberschicht doch zum gesellschaftlich Unabdingbaren, ein Testament zu verfassen und schon lebzeitig publik zu machen. Diese Wechselwirkung zwischen Selbstdarstellung und Schaffung einer Beurteilungsgrundlage fur das postmortale Ansehen fuhren zu einer hoch interessanten und aussagekraftigen Informationsquelle. Das Buch geht aus Paulus' juristischer Habilitationsschrift (Ludwig-Maximilians-Universitat, 1990) hervor, die insbesondere juristische Quellen bzw. die juristische Bewertung von Testamentsklauseln berucksichtigte. So erschliessen sich fur die Mentalitatsgeschichte weite Quellenareale, die bislang meist der romisch-rechtlichen Zunft uberlassen wurden. |
