Publisher Description: Polygamy tests the first two pillars of family property law, namely matrimonial property regimes and inheritance. During his lifetime, the polygamous husband has several matrimonial regimes. Upon his death, regardless of his matrimonial regime, several spouses may survive him. In matrimonial regime law, the Togolese legislator's favour, for example, for the plurality of regimes of separation of property of the polygamous spouse maintains an illusion. It is not free from reproach. It is, moreover, challenged by the plurality of communities revealed by other legal systems. In inheritance law, the plurality of surviving spouses has a status which varies between joint ownership and joint ownership and the participation of several surviving spouses means the accumulation or distribution of the emolument devolved to the surviving spouse by law. |
